TOS / Terms of Service

By using our services you hereby agree to our Terms of Service (TOS);

1: Client Obligations

You agree that the information which you provide us during the order/registration process is accurate, complete and truthful. You normally wont receive any postal mail from us, promotional or otherwise we just require this information to help prove that you are who you say you are, all payments and orders we receive will be checked for fraud.

You also agree that you will not attempt to defraud us in any way, shape or form and if we find that you do your account will be subject to IMMEDIATE termination or suspension without warning. Also if we suspect a fraudulent transaction then it is at our sole discretion to decide whether or not to accept and process the order. We also reserve the right to report any fraudulent transactions or activity to the appropriate authorities along with any necessary details.

2: Non-Payment Policy

We expect any due payments to be made on time and you agree that in the event that you do not make any due payments on time we may suspend your account until such time as when we receive any due payments

However we do appreciate that from time to time you may not be able to make payments on time for whatever reason so if we are notified in advance that you may not be able to make a due payment on time we can grant a “grace extension” of up to one week (upon request) after the due date for you to pay any due payments without your account being suspended but if after that date the payment still is not made we may suspend your account.

Also if any payments are canceled after order or a chargeback is made you agree that we may at any time suspend or terminate your account without warning.

3: Refund Policy

We are confident that you will find our service reliable and satisfactory but if in the unlikely event you're not satisfied with our service you may for 14 days from date of purchase request a FULL refund but you agree that you must give a justifiable reason for your request and if we feel your refund request is not justifiable you agree that we may refuse your request, for example if you say our server is constantly down when it is not (non-exhaustive list) and you also agree that you are only eligible for a refund if you are a new client.

You also agree that in the event your account is suspended or terminated for breaking TOS during the 14 days before the end of the money back guarantee that you forfeit your eligibility for a refund.

4: Staff Abuse Policy

Abuse towards our staff will not be tolerated in any way and may even result in your account being suspended, remember our staff are always professional and will treat you with respect. It’s only fair you treat them the same way in return. This includes;

yelling

swearing

rudness

5: Acceptable Use Policy

You agree that you may not use your hosting account for any of the following reasons, including but not limited to;

hosting proxies

IRC

warez / warez linking

using nulled/cracked scripts, including vbulletin

video sharing / streaming

adult material/websites (no nudity or porn)

download scripts such as rapid leech

sending spam (Mass Unsolicited E-Mail)

phishing

child pornography

racism, hate, defamatory or terrorist related sites or material

illegal broadcasting (illegal broadcasting of television shows)

You also agree that you will not upload illegally oriented or otherwise questionable content. material or sites to our server including but not limited to; warez, serials, cracks, viruses, trojans, child pornography, racist, terrorist related sites, content or material. Nor may you use our server for any unlawful purpose(s) if you are found to be doing so you agree that we may at any time suspend or terminate your account without warning or notice.

You agree that you will not hack, crack, disrupt, disable or otherwise attempt to access our servers or bypass security features thereof in any way shape or form including but not limited to; uploading viruses/trojans, brute force attacks, DDOS'ing this also includes specific attacks on any given customer hosted on our server any account found to be in violation of this policy will be subject to IMMEDIATE termination/suspension and we also reserve the right to report any illegal activities to the appropriate authorities, this includes any legally questionable activities.

You also agree that we may monitor your account as and when we see fit to ensure both overall stability of the server and security of the server and you also agree that we monitor your account to ensure TOS compliance.

6: Legal Stuff

ServerDaemon can make no guarantees as to availability of the service however if you are not satisfied with our service you may request a full refund for 7 days from date of purchase (refund policy applies).

You also agree that you are solely responsible for backing up your data/sites, if you do not make them and you get suspended or delete it then it is your own fault and we cannot help you even if your data becomes corrupt or goes missing all together.

You also agree that in the event your account is suspended twice as a result of a breech of TOS, we may at our discretion charge you a non-refundable re-activation fee of $12.99 and if this fee remains unpaid your account will remain suspended and you also agree that if after the re-activation fee is paid your account gets suspended again your account will remain suspended indefinitely until such time as we see fit to remove it from our server.

You also agree that if there are any errors on your scripts or site which are not caused by any errors at our end that we are not obliged to fix them, we are not going to code your site for you we recommend you hire a coder for that.
